The Mwanza Magistrate’s Court has acquitted Dr. Yahya Nawanda, former Regional Commissioner of Simiyu, of charges related to sexual assault.
This outcome comes after extensive hearings and a review of the evidence presented during the trial.
Chief Magistrate Erick Marley announced the acquittal after it was determined that the prosecution failed to substantiate the claims with sufficient proof. In a statement, Magistrate Marley highlighted three key factors influencing the decision: the lack of scientific evidence, discrepancies in witness testimonies, and inconclusive findings from medical examinations that could not confirm whether bodily fluids were linked to Dr. Nawanda.
Expressing gratitude after the verdict, Dr. Nawanda shared his relief and appreciation. “I thank God, the compassionate one, my family for their support, and the court for upholding justice. My thanks also go to my brother Alex for his tireless efforts,” Dr. Nawanda said. He added, “God is good, and all glory belongs to Him.”
The case, which began earlier this year, put Dr. Nawanda under significant scrutiny. Throughout the proceedings, he consistently maintained his innocence, asserting that the accusations were unfounded and politically motivated. The trial, seen by many as a critical test of the judicial system’s ability to handle allegations involving public figures, ended with Dr. Nawanda being cleared of all charges.
Magistrate Marley’s ruling underscored the importance of credible and substantial evidence in criminal proceedings, especially in cases involving high-profile individuals. While the acquittal was met with relief from Dr. Nawanda and his supporters, it also stirred discussions about the broader implications for public figures and the handling of sensitive cases.
