US Suspends Major Indian Tech Firms From Green Card Programme

The United States has reportedly suspended several major technology companies, including Infosys, Tata Consultancy Services (TCS), Wipro, HCL Technologies and Cognizant, from participating in its Permanent Labour Certification (PERM) programme, a key pathway through which employers sponsor foreign workers for permanent residency.

The reported move could create uncertainty for foreign technology professionals whose employers are sponsoring their applications for US permanent residency, particularly Indian nationals working in the American technology sector.

The PERM programme requires employers, in most cases, to demonstrate that sufficient qualified, willing and available American workers cannot fill a particular position and that hiring a foreign worker will not adversely affect the wages and working conditions of similarly employed US workers.

The labour certification is generally an important step before an employer can proceed with the relevant employment-based immigration petition. However, PERM is not itself a visa or a Green Card.

Any suspension affecting an employer’s participation in the programme could delay new applications or disrupt pending cases, depending on the scope and duration of the restrictions.

Thousands of foreign professionals could face uncertainty over their long-term employment plans and immigration processes if the reported restrictions are confirmed and remain in place.

However, the impact would vary depending on each worker’s immigration status, the stage of their application and whether alternative legal pathways are available. A restriction on an employer’s PERM participation does not automatically mean that all its foreign employees will lose their jobs or legal immigration status.

Indian technology companies have a substantial presence in the US market, providing software development, consulting, digital transformation and other services to American businesses.

Companies such as Infosys, Tata Consultancy Services, Wipro, HCL Technologies and Cognizant have helped supply skilled professionals to the technology sector, making employment-based immigration an important consideration in their international operations.

The reported suspensions could force affected employers to review their recruitment strategies, immigration sponsorship arrangements and workforce planning while seeking clarification from the relevant US authorities.

The development also highlights the broader debate over balancing the demand for specialised technology skills with efforts to protect employment opportunities for American workers.

For foreign professionals seeking permanent residency through employer sponsorship, the key questions will be whether the reported restrictions are formally confirmed, how long they will remain in force and how they will affect applications already in progress.
