Former Ubungo Mayor, Boniface Jacob, has been denied bail as of September 26, 2024, following a new application submitted by the Government’s legal team at the Kisutu Resident Magistrate’s Court.
The decision came after a scheduled ruling on an earlier government application was delayed due to the submission of additional sworn evidence.Chief Magistrate Franco Kiswaga had been poised to deliver a verdict on the government’s initial application, which was presented on September 19, 2024. However, just before the anticipated ruling, the prosecution introduced a supplementary affidavit, prompting the court to adjourn the case to October 1, 2024. During this adjournment, the court is expected to consider the implications of the new evidence and make a ruling.

Boniface Jacob, a prominent member of the opposition party CHADEMA, faces serious charges, including the publication of false information on social media platforms. The allegations have raised concerns about freedom of expression and political repression in Tanzania, particularly against opposition figures.

Introducing a new witness at this stage is inappropriate,” Kibatala stated. “We believe the court should have rendered a decision based on the original evidence, which would have yielded a favorable outcome for Boniface. The court’s decision to delay the ruling until October 1, 2024, reflects its careful consideration of the matter.”

The case has garnered significant media attention, with many observers viewing it as a litmus test for Tanzania’s judicial independence and the treatment of political dissent. As the situation unfolds, it remains to be seen how the court will navigate the complexities of this politically charged case
