The High Court of Kenya in Nairobi County has ordered police officers to produce Tanzanian activist and CHADEMA cadre Twaha Mwaipaya before the court on Monday, November 2, 2026, at 11:00 a.m., whether dead or alive, to clarify his whereabouts and the circumstances surrounding his alleged arrest and detention.
The order was issued on October 30, 2026, by Justice Alexander M. Muteti following an application filed by VOCAL Africa and its partners seeking judicial intervention over Mwaipaya’s reported disappearance.
According to the court order, Kenya’s Inspector General of Police, the Directorate of Criminal Investigations (DCI) and the Officer Commanding Ruai Police Station have been directed to ensure that Mwaipaya is presented before the court together with the original detention warrant.
The officers are also required to explain the reasons for his arrest and detention and why he should not be released immediately.
In a statement, VOCAL Africa said the legal application was filed alongside its partners following reports that Mwaipaya had been abducted. The organisation called for government accountability and an end to abductions and enforced disappearances.
The court further directed the respondents and other parties involved in the case to submit their responses before 9:00 a.m. on Monday, November 2. The matter is scheduled for mention at 11:00 a.m. the same day for further directions.
